§ 1 General Provisions & Applicability
a) These terms apply to all services provided by Parently through the website Parently.se.
b) Scope of application: These general terms and conditions (hereinafter referred to as the "GTC"), in the version valid at the time the customer places an order, apply to all orders placed in the online shop www.parently.se.
c) By using our website, placing an order, or renting products from Parently, you confirm that you have read, understood, and agree to comply with these terms, as well as any other guidelines referred to herein.
d) Parently reserves the right to update or amend these terms at any time. We will inform users of any changes by updating the terms on our website. Continued use of the website after such changes will be considered acceptance of the new terms.
§ 2 Definition of Service
2.1 Conclusion of the Agreement
a) The mere presentation of rental and purchase items in the online shop does not constitute a legally binding offer to conclude a rental and/or purchase agreement. The product range in the online shop is non-binding and subject to change. By clicking the "Order now" button, the customer submits a binding offer to conclude a rental and/or purchase agreement, provided that they have previously agreed to these terms by ticking the designated box and have confirmed the right of withdrawal.
b) Receipt of the customer's order is confirmed immediately by email; however, this order confirmation does not yet constitute acceptance of the offer by Parently. It merely serves to inform the customer of receipt of the order and contains the statutory information about Parently as a potential rental and/or purchase agreement partner, together with these terms and the right of withdrawal.
c) Parently's acceptance of the agreement takes place through a separate order confirmation sent by email. If a rental and/or purchase item is not available or not in the current version, the customer will be notified by email within 3 business days.
2.2 Prices
All rental prices are quoted in SEK, including VAT, unless otherwise stated. Delivery and return fees apply in accordance with the information provided on the website. Parently reserves the right to annually adjust the price for ongoing rentals in accordance with the consumer price index (CPI).
2.3 Rental Period
1. Long-term rental (rental period of more than 2 months)
The rental period begins on the delivery date chosen by the customer at the time of ordering, or at the latest on the actual delivery date if delivery occurs after the chosen date. If collection has been agreed, it is the customer's responsibility to collect the rental product on time. In the event of a delivery delay caused by Parently, the rental period begins on the day the product is actually delivered. The rental period runs for the agreed minimum term and is thereafter automatically extended by one (1) month at a time, unless the rental agreement is terminated in accordance with Parently's general terms and conditions.
2. Short-term rental (rental period of up to 2 months, or products labelled "short-term")
For short-term rental products, the rental period begins on the delivery date chosen by the customer when ordering and ends on the end date chosen by the customer at the time of purchase.
If the customer is unable to return the rental product within the agreed rental period, the customer must inform Parently in writing, before the rental period expires, via hej@parently.se. Parently will then calculate and notify the customer of any additional fee for the extended rental period.
If the customer does not inform Parently of the extended use and Parently itself has to contact the customer to request the return or extension, Parently is entitled to charge an administrative fee of SEK 200 per rental product in addition to the additional rental fee for the extended rental period.
For information on how and when the rental product must be returned, please refer to the section "Termination of the agreement".
2.4 Early Termination
We distinguish between short-term rental (less than 3 months) and long-term rental (3 months or more):
1. Right of withdrawal for short-term rental (rental period of up to 2 months, or products labelled "short-term")
a) If you cancel at least 6 days before the planned delivery date, you are entitled to a 100% refund.
b) If you cancel within 5 days before the delivery date, or return the product earlier than agreed, you are not entitled to a refund. This is because short-term products are reserved exclusively for you during the ordered period, and we have a limited number of available products.
2. Right of withdrawal for long-term rental (rental period of more than 2 months)
a) If you cancel before the product has been collected by our logistics partner (normally at least 6 days before the delivery date), you are entitled to a 100% refund.
b) If you cancel the purchase after the product has been dispatched by us / collected by our logistics partner (e.g. DHL) but before you have received or collected the product, you will receive a refund minus a fee of SEK 299 per package. This fee covers the costs charged by our logistics partner for handling and return. If the package's circumference exceeds 300 cm, the return shipping cost may be considerably higher depending on the size and weight of the package(s), and may amount to up to SEK 2,000, which we would then need to charge in addition.
c) The rental service is deemed to have commenced once the product has been received or collected by the customer. The customer has the right to withdraw from the agreement within 14 days of receipt. When exercising the right of withdrawal, the customer will be charged the rental fee for the first three (3) months (calculated based on the rental fee applicable to the rental period of 3+ months) to cover costs already incurred (including but not limited to reconditioning and cleaning). In addition, the customer must bear the costs of delivery (SEK 90 per order) and return (SEK 90 per return label). If the package's circumference exceeds 300 cm, the return shipping cost may be considerably higher depending on the size and weight of the package(s), and may amount to up to SEK 2,000, which we would then need to charge in addition. As a customer, you are responsible for the goods until they reach us, including during transport. This responsibility includes ensuring that the product is not damaged or lost during return shipping.
2.5 Termination of Rental Agreement
a) Long-term rental (more than 2 months)
Long-term rentals are subject to a minimum rental period as stated on the website, unless otherwise explicitly agreed. After this period, the rental agreement is automatically extended by one (1) month at a time, unless the customer terminates the agreement at least 14 days before the end of the current rental period and returns the product no later than three (3) days after the rental period has expired. The customer is responsible for providing sufficient proof that the product was returned on time. Termination of the agreement must be made via Parently's Self-Service Portal.
b) Short-term rental (up to 2 months, or products labelled "short-term")
Short-term rentals have a fixed rental period and end automatically at the end of the agreed period, provided the product is returned on time.
- If the product is returned in person, it must be received by Parently no later than the last day of the rental period.
- If the product is returned by shipping, it must be handed in for shipping no later than the last day of the rental period and must reach Parently no later than 3 days after the end of the rental period.
If these conditions are not met, the customer will be charged the difference up to the next applicable rental period. It is the customer's responsibility to ensure that the return is made on time and to keep proof that the return has been shipped.
Note: The following points apply to both long-term and short-term rentals:
1) The customer must either ship the product or return it in person to the location specified by Parently, so that it is received no later than 3 days after the rental period has ended. If the product is not returned on time, the rental period is automatically extended a) by one month for long-term rentals, or b) until the product is returned, for short-term rentals.
2) The customer remains responsible for the product until it has been returned. If the product is not returned on time, rental fees will continue to accrue.
3) Upon return, the product must be in good condition, with due regard for normal wear and tear, and all parts supplied with the product must be included. Washing is not required.
4) The product is not considered returned until it has been received at Parently's warehouse and registered as returned in the system.
2.6 Non-payment
If payment is not made, Parently will make a further two attempts to process it. Each attempt will be accompanied by a reminder by email offering the option to manually transfer the outstanding fee to Parently's bank account. If payment remains outstanding after these reminders, Parently reserves the right to charge collection costs of SEK 180 per case (pursuant to § 5 of the Swedish Debt Collection Act), a reminder fee of SEK 60 per overdue invoice, and to request the immediate return of the item.
Parently reserves the right to hand over unpaid invoices to external debt collection partners.
Failure to return an unpaid product within 7 days may result in legal action. Furthermore, Parently reserves the right to charge: a) for a rented new product, the full price according to the brand's standard price list, or b) for a rented "pre-loved" product, the price according to the brand's standard price list minus a "pre-loved" discount of 15%.
2.7 Theft and Loss
a) In the event of loss or theft of the rental product, the customer must inform Parently by email within 24 hours of discovering the incident and report the incident to the police. A copy of the official police report must be sent to Parently without delay.
b) In such cases, the customer is obliged to compensate Parently for the loss based on the current replacement value of the rental product, according to the manufacturer's official price list.
c) Rental fees will continue to be charged until Parently has received the official police report and the incident has been registered.
d) Upon receipt of the police report, Parently may offer a replacement product for a one-time fee based on the manufacturer's official sales price. If the product has been seized, confiscated, or otherwise come into the possession of a third party, the customer is obliged to inform Parently immediately.
2.8 Availability
All rental agreements are offered subject to product availability. Parently does not guarantee the availability of specific products at any given time. If an ordered product becomes unavailable after the order has been placed but before the estimated delivery date, Parently reserves the right to offer an equivalent replacement product. The replacement product shall correspond to the ordered product in function and quality, and the customer will never be charged a higher price than that agreed for the original order.
§ 3 Services and Support from Parently upon Conclusion of a Rental Agreement
a) Upon conclusion of a rental agreement, the rental item—possibly customised according to the customer's wishes—will be shipped to the customer and made available for the agreed duration of the rental period. Parently will make every effort to deliver the product on the desired delivery date.
b) The rental item is provided to the customer for rental purposes only. Parently remains the owner of the rental item, and ownership is not transferred to the customer.
c) The product description in the online shop states what is included in the delivery of the rental item.
d) Parently is responsible for the maintenance and repair of the rental item, provided that the wear and tear is due to the customer's normal use (hereinafter referred to as a "service case"). Service due to intentional or grossly negligent damage to the rental item is not covered.
e) Parently strives to maintain, repair or service the rental item within 48 hours of the customer contacting Parently by phone, email or chat. The customer should provide appropriate evidence of the necessary maintenance or repair in the relevant service case.
f) If the customer requests service that does not constitute a service case, Parently is entitled to charge a fee as agreed with the customer.
g) If Parently replaces a rental item, the customer must immediately hand over or return the item being replaced to Parently.
§ 4 Use of Rental Products and Care Requirements
The customer is obliged to comply with the following conditions throughout the rental period:
a) The customer has a general duty of care for the rental product and must exercise reasonable care to prevent deterioration beyond normal wear and tear. This includes the obligation to maintain the product through regular cleaning and careful handling to avoid abnormal wear, damage or deterioration due to negligence. The product must be treated as if it were the customer's own, so that it can be reused by other families.
b) The customer may only use the rental product in accordance with the rental agreement, the accompanying instructions, and for its intended purpose.
c) The rental product is provided as is and may show signs of previous use, which constitutes normal wear and tear.
d) It is permitted to travel with the rental product, but the customer must ensure that the product is safely stored during transport to prevent damage. If safe storage is not possible, the product must be carried as hand luggage.
e) The customer must handle and store the rental product in a manner that prevents damage, unauthorised use or theft. Parently covers the costs of repairs or spare parts if damage occurs through normal use.
f) The customer may not sublet, transfer or otherwise pass on the rental product to a third party without Parently's written consent.
g) The customer may not alter, remove or tamper with any identifying labels, markings or tags on the rental product. Any damage to or illegibility of such markings must be reported to Parently immediately.
h) The rental product may not be integrated into real property or other fixed assets.
i) The customer may not pledge, transfer or otherwise grant rights to the rental product to a third party.
j) In the event of negligent use, loss, theft or damage to the rental product or its parts, the customer is obliged to compensate Parently for the resulting damage or loss.
§ 5 Defects, Damage and Damage Protection
a) Upon receipt of the rental product, the customer must inspect the product for visible defects or damage. Any defects must be reported to Parently by email within seven (7) days of delivery. If no report is submitted within this timeframe, the product is deemed to have been received in the expected condition.
b) The customer is obliged to report any damage to the rental product to Parently by email as soon as possible, but no later than within two (2) days of the damage occurring or becoming known. The report must include a clear photo of the damage.
c) In the event of damage or excessive wear beyond what is considered normal use, Parently reserves the right to charge the customer for the costs of repair or replacement, based on Parently's assessment. The customer has the option to purchase damage protection via the website to limit their liability in such cases.
d) If the rental product is a car seat and it has been involved in a traffic accident, the customer must immediately inform Parently. A replacement seat will be provided, and Parently will issue an invoice that the customer can use to claim compensation via their car insurance.
e) Any legal claims the customer may have against Parently relating to damage caused by Parently must be made within one (1) year from the date the claim arose. Claims submitted after this period will be considered invalid.
§ 6 Extraordinary Termination (applies only to rental agreements with the customer)
a) Both parties to the agreement have the right to terminate the rental agreement with immediate effect if there is an important reason, to the extent that the other party has breached its contractual obligations to such an extent that it is not reasonable for the agreement to continue.
b) Important reasons for Parently to terminate the agreement include, but are not limited to, the following:
- The customer is in arrears with payment of two consecutive monthly fees or an amount equivalent to at least two monthly fees.
- Enforcement measures have been taken against the customer and/or there are registered payment defaults in the records of the Swedish Enforcement Authority (Kronofogden).
- The customer uses the rental product in a materially non-compliant manner despite Parently having issued a warning.
- The customer repeatedly and without valid reason misuses Parently's service offerings under §3, particularly in cases where there is no significant wear on the product, or where wear has arisen due to improper or intentionally damaging use.
§ 7 Special Terms for Concluding Purchase Agreements with Parently
a) Parently marks items for sale in the online shop as "purchase products", for which the customer may submit an offer to conclude a purchase agreement at the stated purchase price.
b) The statutory provisions apply with respect to liability for material defects (warranty).
c) Ownership remains with Parently (retention of title) until full payment for the purchased item has been made.
d) Parently has the right to make partial deliveries (items out of stock or shipped from different locations), provided this is reasonable for the customer and provided the customer's interest in the agreement as a whole has not been negated by the partial delay or partial delivery.
§ 8 User Accounts and Registration
a) Customers must create a user account in order to place orders and access our services. The customer is responsible for keeping their account information confidential.
b) The customer agrees to provide accurate, current and complete information upon registration and to update such information to keep it accurate and complete.
c) Parently reserves the right to suspend or terminate accounts if incorrect, false or incomplete information is provided, or if any illegal or fraudulent activity is detected.
§ 9 Payments
a) Upon ordering, the rental fee for the first rental month, together with applicable shipping costs, becomes due for payment.
b) Subsequent (recurring) rental fees are due monthly in advance for the upcoming month.
c) Parently accepts payments via the various payment methods specified on the website.
d) Parently reserves the right to delay or refuse orders for security reasons or due to payment issues.
e) In the event of late payment, default interest of 8 percent will be charged from the date payment was due.
f) Parently reserves the right to charge fees for payment reminders sent and late fees in accordance with the policy applicable at any given time.
g) By providing payment information, the customer confirms that they are entitled to use the chosen payment method and that all payment information provided is correct.
§ 10 Credit Check
a) Credit assessment: In order to offer rental services, Parently carries out a credit assessment of the customer via one or more third-party providers, such as CRIF, Creditsafe or Checknode AB. To enable the credit assessment, the customer may need to provide their national identity number (Sweden and Denmark) and date of birth. If the customer does not have a national identity number, "noID" may be entered, following which a manual credit assessment may be carried out.
b) Conditions for validity of the agreement: An approved credit assessment is a prerequisite for a valid order confirmation and for Parently's fulfilment and delivery of the order.
c) Handling of credit assessments: One or more credit assessments may be carried out during the ordering and fulfilment process. The number of credit assessments carried out by Parently does not affect the customer's creditworthiness, credit rating or future credit assessments. Parently does not store or disclose information from the credit assessment beyond what is necessary to administer the rental relationship and comply with applicable law.
d) Misuse of the ordering process: If a customer attempts to circumvent a declined credit assessment by placing repeated orders or otherwise misuses the ordering process, Parently reserves the right to charge a fee of SEK 30 for each credit assessment carried out, to cover the associated costs, as well as a one-time administrative fee of SEK 300.
e) Payment information: By providing payment information, the customer confirms that they are entitled to use the chosen payment method and that all payment information provided is correct and complete.
§ 11 Rental Deposit
Parently reserves the right to request a deposit of up to 50% of the product's regular retail price before accepting a rental agreement initiated by the customer. This deposit may be required to secure the rental agreement and will be clearly communicated at checkout when ordering.
The deposit amount may be wholly or partly withheld to cover:
• Unpaid or outstanding rental invoices, and/or
• Costs arising from products not returned or damaged in accordance with these general terms and conditions.
Any remaining deposit amount will be refunded to the customer once all contractual obligations have been fulfilled and the rental product has been returned in accordance with Parently's return policy.
§ 12 Delivery, Notice Period and Returns
a) Parently delivers rental items to addresses in Sweden and Denmark. Delivery times and fees may vary depending on location and the specific product ordered.
b) Parently cannot guarantee that delivery will take place exactly on the desired or selected date. Delivery times are affected by external factors and our logistics partners, which means delays may occur. No right to compensation, price reduction or damages arises from delayed delivery beyond Parently's control.
c) If the customer chooses delivery to a pick-up point, Parently reserves the right to charge a fee of SEK 199 for deliveries not collected within the specified time.
d) Customers must inspect items upon delivery and notify Parently within 24 hours of any defects or issues.
e) At the end of the rental period, customers must return the products in their original packaging, including all components according to the manufacturer's parts list.
f) Parently provides a return label for the products, which you print yourself. It is the customer's responsibility to follow the return instructions provided and ensure that products are returned on time.
g) Notice period: Cancellation of the subscription must be made no later than 7 days before the desired end date via the customer's user account. This ensures that you, as the customer, have enough time to return the product on time, and that we can plan for the next rental to a new family. Example: If you wish to end your subscription on 24 June, the cancellation must be registered no later than 17 June. If cancellation occurs later than 7 days before the end date, the subscription will automatically be extended by an additional month.
§ 13 Product Exchanges
a) The customer has the right to request one (1) product exchange during a period of twelve (12) months from the date the subscription was activated.
b) The twelve-month period begins to run from the date the subscription is first activated.
c) A fee for product exchange is charged to cover administrative, inventory-related and operational costs. The applicable fee is stated on the company's website or can be obtained from customer support upon request.
d) The product exchange can only be made to an item within the same product category and price range, where the new item's price is no more than 10% lower than the price of the original product.
§ 14 Extension of Rental Agreements
a) Short-term rental (up to 2 months, or products labelled "short-term")
The customer may request an extension of the agreed rental period before the rental period expires. An extension is granted subject to product availability and Parently's approval.
Upon approval of an extension, the customer will be charged fifty (50) percent of the standard short-term price for the requested extension period. The fee is calculated solely on the basis of the additional rental period and is not affected by the length of the original rental period.
Example: If a customer has rented a product for five (5) days and wishes to extend the rental by a further three (3) days, and the standard rental price for a three (3) day rental period is SEK 300, the customer will be charged SEK 150 for the extension.
b) Long-term rental (subscriptions over 2 months)
After expiry of the agreed minimum term, the rental agreement is automatically extended by one (1) month at a time in accordance with these general terms and conditions, until the customer terminates the agreement in accordance with the applicable termination rules.
If the rental product is not returned in accordance with these general terms and conditions, the rental agreement continues to run automatically and the applicable monthly rental fee will be charged until the product has been received and registered as returned by Parently.
§ 15 Liability and Warranty
a) In the case of minor negligence, Parently is only liable for breaches of material contractual obligations (cardinal obligations). These are obligations that the agreement is intended to impose on Parently based on its content and purpose, or whose fulfilment is necessary for the agreement to be properly performed. The customer may reasonably rely on the fulfilment of these obligations. Liability is limited to typical damages that were foreseeable at the time the agreement was concluded.
b) The personal liability of Parently's legal representatives, agents and employees for damages caused by them through slight negligence is likewise limited to the extent described in § 3.
c) Parently is not liable in cases of unauthorised and/or unlawful use of rented or purchased products.
d) The above limitations of liability do not apply in cases of intentional or grossly negligent damage, for damages caused by defects resulting in personal injury (bodily injury and harm to life and health), for liability under the Product Liability Act, and in cases of other mandatory liability provisions. Furthermore, they do not apply if and to the extent Parently has provided a warranty.
e) The customer is fully liable in accordance with applicable law.
§ 16 Privacy and Data Protection
a) Parently values the customer's privacy and works to protect personal data. Please see our privacy policy for detailed information on the collection, use and storage of data.
b) By using our services, you consent to the collection and processing of your personal data in accordance with applicable law and the terms set out in our privacy policy.
§ 17 Applicable Law and Jurisdiction
a) These terms of use are governed by Swedish law.
b) Any disputes arising from or in connection with these terms or the services provided by Parently shall fall under the jurisdiction of the Swedish courts.
